Terms of use

Growthwing provides companies and freelancers with an application to assemble teams of artificial intelligence agents, give them missions, follow their execution and receive their deliverables. Using the website and the application constitutes acceptance of these terms. If you accept them on behalf of a company, you confirm that you have the authority to bind it.

The service is intended for a professional audience. The provisions of the French Consumer Code relating to consumers do not apply, except where public policy provides otherwise.

The application is offered in a private phase: it is open by invitation, to be tested with its first users. As such, its features, usage limits and interface may change, some functions may be unavailable, and Growthwing does not guarantee the continuity or performance of the service during this phase.

Growthwing is free for fourteen days from the opening of your access. At the end of that period, you may continue by choosing the plan that fits your needs, with a minimum three-month commitment, under separate terms of sale that will be presented to you and that you will expressly accept. Private-phase participants get a preferential rate on every plan and early access to beta features. No amount is due or charged without that acceptance. Otherwise, your access ends at the close of the free period, and your data is handled in accordance with the privacy policy.

Access to the application requires an invitation issued by Growthwing, then the creation of an account. You undertake to provide accurate information and keep it up to date, to keep your credentials confidential, and to report any unauthorised use of your account to us without delay. You are responsible for how the service is used from your account.

A company administrator may invite members, assign them roles and open departments. They are responsible for the use of the service by the people they invite.

You may use the service for the needs of your professional activity. It is prohibited:

• to entrust it with unlawful, defamatory or infringing content, or content that violates the rights of third parties;
• to entrust it with third-party data you are not entitled to use, or special categories of data within the meaning of Article 9 of the GDPR;
• to use it to produce misleading content presented as coming from a natural person, unsolicited canvassing, or any activity contrary to law;
• to attempt to access another company’s data, circumvent security measures, extract the service’s content in bulk or disrupt its operation;
• to resell, sublicense or make access to the service available to third parties without Growthwing’s written consent.

Growthwing may suspend or close an account in the event of a breach, after informing you unless the matter is urgent.

The answers, deliverables and presentations produced by your teams are generated by artificial intelligence systems. They are identified as such in the application. They are an aid to decision-making and work, not legal, accounting, tax, financial or medical advice. You remain the sole judge of how to use them, and it is your responsibility to check them before any decision or distribution, in particular content intended for third parties (follow-ups, proposals, job ads, communications).

The Executive department can prepare transfer orders from the accounts you choose to connect. No order is executed without your express confirmation in the application, and you remain solely responsible for the transactions you confirm.

You remain the owner of the content you entrust to the service (requests, attachments, company data). You grant Growthwing, for the duration of your use, the right to host, process and pass it to its processors solely to the extent needed to provide the service.

The deliverables produced for you are assigned to you upon delivery, for all uses, within the limits of the law. Growthwing claims no rights over them and does not reuse them for other clients. The company memory built up over your missions belongs to your company.

The application, its engine, its interfaces, its trademarks and the team member portraits remain the property of Growthwing or its partners.

Growthwing strives to keep the service available at all times, without being bound to do so. Interruptions may occur for maintenance, updates or incidents, including at a processor. Growthwing may change the service, add or remove functions, and informs users when a change affects them significantly.

Growthwing is bound by an obligation of means. To the extent permitted by law, Growthwing is not liable for indirect damage, loss of revenue, customers or data resulting from use of the service, nor for decisions made on the basis of the content produced, nor for the acts of a third party or force majeure. During the free period, Growthwing’s liability is in any event limited to direct and proven damage.

Nothing in these terms limits Growthwing’s liability for gross negligence or wilful misconduct, or its obligations regarding the protection of personal data.

The processing of personal data is described in the privacy policy. When you entrust the service with personal data of third parties (customers, employees, suppliers), you act as controller and Growthwing as processor; you warrant that you have a legal basis for that processing. A data processing agreement compliant with Article 28 of the GDPR is available on request.

These terms apply for as long as you use the service. You may close your account at any time from the application or by writing to us. Growthwing may end the private phase or your access with reasonable notice, except in the event of a serious breach. On closure, you may retrieve your deliverables for thirty days; your data is then deleted under the conditions of the privacy policy.

Growthwing may amend these terms. The version in force is the one published on the website, dated at the top of the page. Users of the application are informed of substantial changes at least fifteen days before they take effect; continued use after that date constitutes acceptance.

These terms are governed by French law. In the event of a dispute, the parties first seek an amicable solution. Failing agreement within sixty days, the dispute falls under the jurisdiction of the competent courts of the place of Growthwing’s registered office, including for interim relief and in the event of multiple defendants.
